BOOKING, PAYMENT, MODIFICATION, CANCELLATION, TERMS AND CONDITIONS, INSURANCE, PERSONAL DATA PROTECTION

1. GENERAL TICKET BOOKING TERMS AND CONDITIONS

(1.1) These Booking and Payment Terms and Conditions (hereinafter: the Terms and Conditions) apply to bookings and tickets (hereinafter collectively: Tickets) made in the call center of the shipping company Sunlines (hereinafter: Service Provider), in the Internet environment, via mobile phone application and at the travel company.

(1.2) Booking a voyage and paying in full or in part for a Ticket shall be deemed to be a binding agreement between the Service Provider and the Ticket Buyer (as defined in these Terms: the individual purchasing the ticket or the group ticket group or the person responsible for private charter).

(1.3) These Terms and Conditions apply to all bookings of services provided by the Service Provider.

(1.4) The special conditions of the General Terms and Conditions apply to the sale of tickets for special trips and / or special offers and group trips (hereinafter: Special Trips):
(1.4.1) Special travel tickets will not be refunded.
(1.4.2) Tickets for special trips can be changed according to a separate agreement in each case.

(1.5) Tickets can be booked and paid for in the Service Provider’s Internet or mobile phone environment or at a travel company.

(1.6) Tickets can be changed and canceled by writing an e-mail to the Service Provider’s representative office at info@sunlines.eu or at the travel company where the reservation was made.

(1.7) The ticket cannot be changed or canceled in the Internet or mobile phone environment.

(1.8) Special wishes:
(1.8.1) In the case of passengers with special needs, the Service Provider must be notified at least 48 hours before the trip.
(1.8.2) Special requests for the menu must be notified to the Service Provider at least 3 working days before the trip.

(1.9) Tickets will be issued only in electronic form by e-mail to the e-mail address indicated by the Buyer.

2. PAYMENT FOR A TICKET

(2.1) In the Internet and mobile phone environment of the service provider, the Ticket can be paid for immediately upon booking. An automatic ticket and invoice will be issued to the customer in case of online payment. The customer can order to pay the invoice by bank transfer. Attention – when ordering an invoice, an invoice handling fee will be added to the Ticket price. When paying for tickets, the cover currency is Euro (€). In the online environment, tickets can be paid for with bank links or the most common credit cards.

(2.2) A reservation made at the service provider’s sales office, by calling the call center or at the travel company shall be paid for on the basis of the invoice and conditions submitted after the reservation has been made.

(2.3) Package trips are subject to conditions different from these Terms and Conditions and they are published together with the package tour offer. The package tour agreement enters into force if the Buyer has paid in advance or submitted a letter of guarantee in accordance with the booking and payment conditions prescribed for package tours.

(2.4) If the Ticket includes a service provided by a third party who is a partner of the Service Provider, the booking and payment conditions of the partner may apply.

3. CHANGING A TICKET

(3.1) Modification of a Purchased Ticket includes modification of Passenger Transport Services (including direction and / or route of travel, date or time of departure, additional services, on-board services).

(3.2) Changing personal data in the Ticket (name, contact) is not changing the Ticket.

(3.3) Upon modification of passenger transport services, the Buyer shall pay a Contractual Penalty on the basis of these Terms and Conditions. In the case of services provided by third parties who are partners of the service provider, the Contractual Penalty established by third parties applies.

(3.4) The ticket may always be changed if the paid services are paid for in accordance with the Service Provider’s price list. When changing the price of a passenger transport service, the price arising from the difference between the price of the services originally purchased and the services changed in the reservation must be paid or the price and the applicable Penalty in accordance with subsections 3.6 and 3.7 of this clause shall be refunded.

(3.5) If the ticket is changed more than 30 days before the departure of the trip, the Contract Penalty shall not be applied.

(3.6) The contractual penalty is applied as follows:
(3.6.1) if the Ticket is changed 30 days to 48 hours before the departure of the trip and the changed Ticket is cheaper, 5% of the total cost of the Ticket will be withheld as a Contractual Penalty and the difference in price remaining as the remaining balance will be refunded;
(3.6.2) if changes are made to the Ticket less than 48 hours before the departure of the trip, 10% of the total cost of the Ticket will be withheld as a Penalty; if the amended Ticket is cheaper, the additional difference between the price of the originally purchased Ticket and the amended Ticket shall be withheld as a Penalty, at the same time the Penalty shall be applied to additional services in accordance with clause 3.7 .; if the changed ticket is more expensive than the original Ticket, the price difference will be paid according to the price list.

(3.7) If the ticket is changed for additional services less than 48 hours before departure, the cost of additional services will be deducted as a Penalty.

4. CANCELLATION OF A TICKET

(4.1) The Service Provider cancels a Ticket for which no payment has been made by the due date.

(4.2) Upon cancellation of a ticket, a Contractual Penalty is required on the basis of these Terms and Conditions. In the case of services provided by third parties, the Contractual Penalty established by them shall apply.

(4.3) Upon cancellation of the Ticket, the amount paid for the Ticket, less the Penalty, shall be returned to the same bank account from which the Ticket was paid. The deposit will be refunded within 60 days. The rates and conditions of the contractual penalty are listed in clauses 4.4, 4.5, 4.6, 4.7

(4.4) If the ticket is canceled more than 30 days before the departure of the trip, the Contract Penalty shall not be applied.

(4.5) The contractual penalty is applied as follows:
(4.5.1) If the Ticket is canceled 30 days to 9 days before the departure of the trip, a Penalty of 10% of the total cost of the Ticket shall be applied;
(4.5.2) If the ticket is canceled 9 days to 48 hours before the departure of the trip, 35% of the total cost of the Ticket will be withheld as a Penalty;
(4.5.3) If the ticket is canceled less than 48 hours before the departure of the trip, 100% of the total cost of the Ticket will be withheld as a Penalty.

(4.6) Failure to appear for the trip is excusable due to force majeure and must be proven by the Ticket Buyer. The circumstances of force majeure and the evidence submitted regarding them shall be assessed by the Service Provider. If the force majeure circumstance is proven, the amount paid for the Ticket will be refunded to the Ticket Buyer and the Contractual Penalty will not be applied.

(4.7) The Ticket Buyer may leave the amount paid for the Ticket as an advance payment for the Service Provider’s future services.

5. GENERAL TERMS AND CONDITIONS OF TRAVEL AND TICKET SALES

SAFETY ON BOARD
(5.1.1.) The service provider has the right not to serve people with signs of intoxication. Smoking on board is only allowed in designated areas. Stitched shoes are not recommended for sea voyages. Pets are allowed under the strict responsibility of the animal owner and must not move freely.
(5.1.2.) All persons on board are required to comply with the safety requirements and the master’s instructions. Spontaneous actions or irregularities are strictly at your own risk and may result in disembarkation. If removed from the trip, the cost of the ticket will not be reimbursed.
(5.1.3.) The captain has the right to change the timetable according to weather conditions and other unforeseen circumstances that may affect the safety of the trip. The cost of the ticket will not be reimbursed in case of changes due to safety.
(5.1.4.) The service provider has the right to change the vessel serving the route as necessary without prior notice. The cost of the ticket will not be reimbursed if a replacement vessel is used during the voyage.
(5.1.5.) Passengers under the age of 18: Children under the age of 18 are not allowed to take a cruise without an adult. An adult is considered to be 18 years of age. The children’s group must have at least 1 adult companion for every 4 children.
(5.1.6.) Attention! Participation in shipping is voluntary and strictly at your own risk.

(5.2) TICKET AND SERVICE PRICES
(5.2.1.) The service provider has the right to change the price list at any time. If you have ordered the trip but have not yet paid, the Service Provider guarantees the validity of the price list during the validity period of the price offer or invoice.
(5.2.2.) The service provider’s products are sold through various agents and it is not always possible to check the nominal values ​​of the price lists used on them. The Service Provider reserves the right not to accept a price that differs from the price established by the Service Provider.

(5.3) LIABILITY
(5.3.1.) The liability of the service provider is laid down in the Maritime Regulations and the 1974 Athens Convention and its annexes. The ticket purchaser and his group are insured in accordance with the Athens Convention.
(5.3.2.) The Service Provider shall not be liable for the personal belongings and assets of the Ticket Buyer and his / her group if they have not been deposited with the Service Provider.
(5.3.3.) The ticket purchaser (the person responsible for the private rental of a group of group tickets or the entire ship) is fully responsible for the activities of the group represented by him, incl. undertakes to compensate in full the property damage caused to the Service Provider.

(5.4) PROTECTION OF PERSONAL DATA
(5.4.1.) The personal data collected for the processing of the Buyer’s order is strictly for internal use.
(5.4.2.) If the Ticket Buyer has given his / her consent, the Service Provider has the right to use the Buyer’s contact information to post a newsletter.
(5.4.3.) We confirm that the Buyer’s personal data will not be released to third parties for purposes other than the execution of the order.
(5.4.4.) The Buyer’s financial data is not stored on the Service Provider’s servers.

6. OTHER TERMS

(6.1) In the direction of destination of island trips, an additional freight tariff applies to items carried in cubic meters.
(6.2) It is prohibited to consume food and drink with you on board a ship.
(6.3) The Ticket Buyer is fully responsible for the activities of the group represented by him, incl. undertakes to compensate in full the property damage caused to the Service Provider; while on the island, the Buyer is responsible for ensuring nature conservation.
(6.4) For the use of electricity consuming equipment from the ship’s mains with a power exceeding 0.5 kW, an energy fee shall be submitted in accordance with the applicable tariff.
